These Terms of Service outline the terms and conditions upon which we will provide you with the services described on our website (“Services”).

  1. Accepting these Terms of Service
    1. Before we can provide you with the Services, you must accept these Terms of Service and agree to be bound by them. You can do this by ticking the box next to the words “I agree to the Terms of Service” when registering your account.
  2. Use of website
    1. In order to access and obtain your loyalty program account information, you authorise us to act on your behalf to retrieve account information for the programs you specify.
    2. We will use the information gathered from the third party sites to prepare reports of your loyalty program point’s activity. These reports will be presented on your account dashboard for your use and in a form determined by us.
    3. Upon the termination of your account with us in accordance with clause 8, we will immediately cease retrieving your account information.
    4. We act solely as an intermediary and assume no responsibility and disclaim any liability for the acts, omissions, or determinations of any loyalty program provider. Individual program benefits are subject to the terms and conditions of those programs.
  3. Our Website
    1. You must use our website in accordance with these Terms of Service, only for lawful purposes and in a way that does not infringe the rights of anyone or restrict or inhibit anyone’s use of our website.
    2. You understand and agree that your use of our website (and access to the Services) is provided “as is” and “as available”. We will take all reasonable steps to ensure our website is secure, confidential, uninterrupted, error-free, accurate, complete and current, however we do not represent or warrant this will always be the case.
    3. We update and carry out maintenance on our website regularly, so we may have to suspend access, service or functionality on our website from time to time, and sometimes without notice. We will not be liable if, for any reason, our website is not available at any time.
    4. Our website may contain links to third party sites and resources, which includes loyalty program sites. Whilst we will use our best endeavours to ensure the reliability of the third party sites and resources, we have no control over those sites, and will not be liable for any loss or damage you suffer or incur when you use a third party site or resource.
    5. We own, or are the licensee of, the intellectual property rights in the content of our website, including text, photos, graphic designs and images.
  4. Your Account
    1. In order for us to provide you with the Services, you must set up an account on our website.
    2. We take all reasonable steps to ensure that your account details are secure, however you are also responsible for maintaining the confidentiality and security of your account (for example, by not sharing your account user name and password) and for all activities on or through your account. You may share your account dashboard with other account holders at your absolute discretion.
    3. Our employees do not have access to your loyalty program(s) passwords and none of our employees can view or retrieve your password from these loyalty program sites. You must notify us immediately of any unauthorised use of your account. We will not be liable for any loss or damage arising in connection with any unauthorised use of your account.
    4. We may disable, suspend or cancel your account if you fail to comply with your obligations under these Terms of Service.
    5. If you forget your password, you will need to click on the “Forgot Password” link, enter your email address and you will be sent password reset instructions.
  5. Our Services
    1. The Services will be provided in accordance with these Terms of Service.
    2. We reserve the right to change or withdraw the Services at any time. If we do so, we will post the details on our website.
    3. In order to redeem your loyalty program points to perform the Services, we require access to your account. We will only redeem points on your behalf as authorised by you. This authorisation may be given to us via the website or email.
  6. Fees and Charges
    1. The current fees and charges applicable to the Services we offer can be found here.
    2. You must pay for the Services by using a valid credit card. The following credit card merchant fees will be applied to all transactions: 1.5% for Visa and MasterCard and 3% for American Express.
    3. You authorise us to charge your credit card for the Services you purchase through our website and for any additional amounts in connection with your account (including cancellation fees and any fee adjustments).
    4. If any charge to your credit card is declined, you authorise us to continue to charge your credit card for the outstanding amount, together with any other applicable fees and charges, on or before the next billing cycle, until payment has been received.
    5. We will provide you with a tax invoice on the same day the transaction is completed, setting out the fees and charges which have been charged to your credit card.
    6. All fees and charges are exclusive of GST unless otherwise stated. If the fees and charges are exclusive of GST, you will pay to us any GST payable for any supply by us in connection with this agreement without deduction or set-off. You will make this payment at the time that the fees or charges are due for payment.
    7. In this clause, GST means any tax, levy, charge or input implemented under the A New Tax System (Goods and Services Tax) Act or an Act of the Parliament of the Commonwealth of Australia substantially in the form of, or which has a similar effect to, the GST Act.
  7. Liability
    1. Except where we are unable to exclude our liability by law, we will not be liable to you for any loss or damage, however it arises, whether in contract, statute of tort (including negligence), arising out of, or in connection with, your use of (including inability to use) our website and the Services.
    2. Our liability for breach of a statutory guarantee which cannot be excluded by law is limited, at our option, to either the supply of the services (or equivalent services) again or the payment of the cost of having the services supplied again.
    3. We exclude liability for any loss of profit, loss or corruption of data, special, exemplary, punitive, incidental, indirect or consequential loss or damages suffered or incurred or arising in connection with our website, any services we have provided, or in connection with any act or omission by us (negligent or otherwise).
    4. To the maximum extent permitted by any law, our liability in connection with these Terms of Services for any breach of such term, condition or warranty will be limited, at our absolute discretion, to any one or more of the following:
        (a) the resupplying of the services again; or
        (b) the payment of the cost of having the services supplied again.
    5. This clause continues in effect after the termination of this agreement.
  8. Termination and suspension
    1. We may disable, suspend or cancel your account and deny you access to our website and the Services with notice to you if you fail to remedy a breach of this agreement within 7 days of us providing you with a notice to do so.
    2. You can cancel your account at any time by emailing us at helpdesk@pointsbank.com.au.
    3. When your account is closed or cancelled for any reason, you will no longer have access to the account.
  9. General Terms
    1. We are bound by the Australian Privacy Principles in the Privacy Act 1988. Your personal information will be collected by or on behalf of us in accordance with our privacy policy.
    2. We reserve the right to change any or all of these terms and conditions, and/or add new terms and conditions at any time. When we do so, we will make a new copy of these Terms of Service available on our website. Your continued use of our website and/or the Services will be deemed to constitute your acceptance of such changes.
    3. Notices required to be given under these Terms of Service may be sent by email, by post or in the case of notices we give you, by making the information available on our website.
    4. These Terms of Service set out the entire agreement between you and us relating to the supply of the goods and/or services described on our website and supersedes all prior discussions and communications.
    5. There is no relationship of employment, partnership, agency or fiduciaries between you and us.
    6. This agreement is governed by and construed under the laws of New South Wales.
    7. Any dispute or difference arising out of these Terms of Service will be submitted to arbitration in accordance with, and subject to, the Institute of Arbitrators and Mediators Australia Fast Track Arbitration Rules. The seat of arbitration will be Sydney, Australia. The language of the arbitration will be English. The number of arbitrators will be one.
  10. Fees
      1. Points Bank is a free website which allows users to register and manage their own loyalty reward schemes. Points Bank does offer consultation for all customers who request assistance with trip planning and points usage. We will charge an initial fee of $250 to plan your international trip and find the best availability and options. If you require Points Bank to transact your points on your behalf a reservation fee of $55 per domestic ticket, and $125 per international ticket will be applied. Once the reservation is completed, changes can be made for a further fee of $55 per amendment per ticket. All fees are non-refundable.
